- INTRODUCTION - DEFINITIONS
 
These general conditions aim to define the terms and conditions of operation and use of the iMAGI-X service made available to the Reseller following the sale of an iMAGI-X Box to a Customer, as described in Article 3 below. The Reseller will be informed of any changes to the T&Cs when connecting to the Service.
It is specified that terms and expressions beginning with a capital letter, whether used in the singular or plural, shall have, for the purposes of these Terms and Conditions of Use, the meaning provided below, or that indicated in bold in the body of these Terms.

                 Means all resellers operating under the MAGILINE brand following the signing of a distribution agreement with Piscines MAGILINE.  |

                 Means the professional who is part of Piscines MAGILINE’s network of resellers, has completed specific training, and from whom the Customer purchased an iMAGI-X Box.  | 
        
| 
                 “Service”  | 
            
                 Means the provision by Piscines MAGILINE to the Customer and the Reseller of the iMAGI-X application via the app downloadable on smartphone and tablet.  | 
        
- PRESENTATION OF PISCINES MAGILINE
 
Piscines MAGILINE is the owner of the iMAGI-X application, which can be downloaded on smartphones and tablets via the online stores of various operating system publishers (notably Apple Store and Play Store).
Piscines MAGILINE is the Technical Administrator (the “Technical Administrator”) of the customer accounts opened by each Customer in the customer area of the iMAGI-X Application. Piscines MAGILINE is also the Technical Administrator of the accounts opened by the Reseller in the reseller area of the iMAGI-X Application.
The e-mail address, as Technical Administrator, is webmaster@magiline.fr . All communications made in connection with the use of the Service shall be carried out by e-mail, unless otherwise provided in these Terms of Use.
Piscines MAGILINE is only the Technical Administrator of the Customer and Reseller Accounts through its IT department.
All other relationships generated by the use of the Service, whether commercial, technical or otherwise, are solely between the Customer and the Reseller and/or the swimming pool Installer, as applicable.
The iMAGI-X Service allows the use of the intelligent filtration box used to remotely control and operate certain swimming pool equipment. The Service uses at least one electrical box, the iMAGI-X Box, installed on the Customer’s pool, which is connected by means of equipment chosen by the Customer. The iMAGI-X Box transmits a number of pieces of information and commands to the iMAGI-X smartphone application.
The iMAGI-X Service gives the Customer the ability to benefit from a right of access to the iMAGI-X Application in order to:
- remotely consult certain information relating to various parameters linked to the use of the swimming pool, in particular the Pool Data,
 - remotely control the start-up and adjustment of equipment installed in the swimming pool,
 - send messages to the Reseller of their pool who is part of the Piscines Magiline distributor network,
 - invite users (family members, tenants, etc.) to access the iMAGI-X solution.
 
Access to the iMAGI-X Service is open to any user wishing to create an account. However, only Customers who own a pool equipped with an iMAGI-X Box installed by an authorized Reseller can benefit from all functionalities.
Access to the Service is free of charge and results in the Customer’s right of access to a personal space reserved for them on the smartphone application that the Customer may choose to download (“the Application”). This space is intended to allow them to carry out the operations listed above (the “Customer Account”).
To create a Customer Account, simply download the iMAGI-X Application and follow the registration procedure.
- Customers who own a swimming pool equipped with an iMAGI-X Box must complete their registration using the unique code indicated on their iMAGI-X Box.
 - Guests can create an account without a code and benefit from limited or general functionalities.
 
To access the iMAGI-X Service, the Customer must:
- own a swimming pool equipped with the iMAGI-X Box, correctly connected,
 - have accepted these Terms of Use when first connecting to the mobile application and, where applicable, have accepted updates to the Terms of Use of which they will be informed when connecting to the Service,
 - have been approved by confirmation sent by e-mail by the Technical Administrator regarding the creation of their Customer Account,
 - have carried out, after receiving confirmation of the creation of their Customer Account, a test that they considered satisfactory of the proper functioning of the iMAGI-X Service.
 
To access the iMAGI-X Service, the Guest must:
- have accepted these Terms of Use when first connecting to the mobile application and, where applicable, have accepted updates to the Terms of Use of which they will be informed when connecting to the Service,
 - have been approved by confirmation sent by e-mail by the Technical Administrator regarding the creation of their Customer Account and by the communication of their login and password to access their Customer Account,
 - have carried out, after receiving their login and password, a test that they considered satisfactory of the proper functioning of the iMAGI-X Service.
 
- Opening of the Reseller Account
 
Membership in the Service by the Reseller results in the Reseller’s right of access to a personal space reserved for them on the smartphone application they must download (the “Reseller Account”).
- Consultation of Pool Data
 
With the Customer’s consent (under the conditions of Article 6 below), the Service allows the Reseller to receive and consult information collected by the Customer’s iMAGI-X Box, particularly Pool Data, via their Reseller Account space in the Application. At the Customer’s request, the Service also allows the Reseller to act on the pool and to activate or deactivate certain equipment.
- Video Call
 
Until February 28, 2022, the Service includes a free video call option (“Video Calls”). Video Calls allow the Reseller to offer the Customer remote interventions by video call on the Customer’s smartphone via the Application.
As from March 1, 2022, the Video Call option will become payable, and will only be accessible to Resellers who have subscribed to this option in the Application. Subscription rates will be displayed in the Application.

- Scope of the Service
 
 
This article details the services included and the services excluded from the scope of the Service.
-

- Services included for the Customer
 
 
 - 
                
 
The parameters that may be consulted and/or modified remotely by the Customer are those appearing on the iMAGI-X Application dashboard, namely in particular: the filtration system, pH, RedOx, water temperature (the “Parameters”). The Parameters are detailed in the User Guide provided to the Customer prior to the purchase of the iMAGI-X Box.
The pool devices and accessories whose start-up and adjustment can be remotely controlled include in particular those relating to water filtration, heating, projector lighting, and accessories powering comfort equipment (the “Devices”).
It is expressly reminded that none of the swimming pool safety devices and equipment can be remotely controlled due to applicable regulations and standards.

- Services excluded for the Customer
 
 
 - 
                
 
The iMAGI-X Service is expressly neither intended nor designed to allow the Customer to:
- to remotely control the safety equipment of their swimming pool,
 - to directly check the proper functioning of the swimming pool equipment, devices and accessories,
 - to directly detect anomalies or malfunctions of said Devices,
 - to directly detect errors or anomalies in the information obtained on the Account.
 
In general, neither the use of the iMAGI-X Box nor the use of the Application can replace the installation of safety equipment whether or not its presence is required by law. The Customer remains solely responsible for the choice of safety equipment installed on their pool, and no request may be made to Piscines MAGILINE in this respect under the Service.
Furthermore, the iMAGI-X Service cannot constitute or generate, even implicitly, any service complementary or additional to the simple right of access to the Customer/Reseller Account.
The Technical Administrator and the Reseller, if authorized to consult the Pool Data as detailed in Article 6.3, even when aware of the information and operations carried out by the Customer on their Account, do not on their own initiative exercise any control over the functioning of the Customer’s pool Devices, nor do they exercise any control over the Pool Data obtained by the Customer when consulting their Customer Account and/or over the use made of such Data by the Customer. The interventions of the Technical Administrator and the Reseller will only take place at the express request of the Customer.
In no way can the iMAGI-X Service replace insurance, maintenance or monitoring services, nor any recommendation, advisory or information service.
- TECHNICAL PREREQUISITES
 
The use of the iMAGI-X Service by the Customer and the expected performance in particular imply:
- that all swimming pool Devices necessary to achieve such performance exist in the pool, are in perfect working order, compatible and properly connected to the iMAGI-X Box,
 - that the Box has been installed by a MAGILINE-certified technician or the Reseller, having completed specific training,
 - that the Customer and the Reseller strictly comply with the instructions in the User Guide of the iMAGI-X Box,
 - that the surrounding area of the pool, due to the Customer’s installations or geographical configuration, does not electrically or otherwise interfere with the detection of the pool Devices used for information consultation or operation commands.
 
The Customer and the Reseller are solely responsible for the rental or adaptation of the installation of the equipment they have chosen to connect to their Customer/Reseller Account and for the rights of use of the software they employ for this purpose. They must have ensured, under their own responsibility, the compatibility of their equipment with the Service. No warranty, even implicit, is given as to the functioning of the Service with all existing terminals.
The Service consists of and is limited to granting the Customer access to a Customer Account within the iMAGI-X Application, the Customer connecting with the equipment of their choice, via compatible communication channels (notably wired Internet or WIFI).
Similarly, the Service consists of and is limited to granting the Reseller access to a Reseller Account within the iMAGI-X Application, the Reseller connecting with the equipment of their choice, via Internet communication channels.
Piscines MAGILINE is therefore not involved in any dispute that may arise between the Customer and the Reseller, and the supplier of their equipment, as well as in any dispute relating to the use of the Customer’s and Reseller’s fixed or wireless communication networks and their access providers.
Piscines MAGILINE is likewise not liable for any direct or indirect damage that may result from a connection by the Customer or the Reseller to their Account.
The Service and its functions, including the mobile/tablet application that may be downloaded by the Reseller, and the process of accessing the Reseller Account, may evolve during their use by the Reseller. In the event of such modifications, an information message addressed to the Reseller will appear upon their first connection following the modification.
Membership in the iMAGI-X Service is subject to its own regime and provides a service to the Customer distinct and independent from other services that the Customer may have otherwise contracted with the Reseller or any other professional party.
At any time, the Technical Administrator may decide to carry out a maintenance operation resulting in the unavailability of the Service for a period of time. A communication will be sent to all active Reseller Accounts.
Access to the iMAGI-X Service and to the Reseller Account is protected by a personalized security system composed of a login and a personal and confidential code assigned by the Technical Administrator when the Reseller subscribes to the Service. Any access to the Service and to the Reseller Account necessarily requires the use of the confidential code.
This personalized security system is under the Reseller’s custody, who is solely responsible for it. Its use is deemed to be strictly personal and engages only the Reseller’s responsibility.
In case of loss of their confidential code, the Reseller may request that their Reseller Account be blocked from the iMAGI-X Application, or by sending a request to the Technical Administrator’s address (webmaster@MAGILINE.fr). The Reseller Account will be blocked upon receipt of the information, and the issuance of a new code can only take place at the Reseller’s request.
The Reseller may at any time change their password and must do so in particular in case of loss, use, or suspicion of use by an unauthorized third party of their personalized security system.
The Technical Administrator has the right to block the Service for reasons related to the security of the Application, to use or suspicion of fraudulent use of the Reseller Account, and to the maintenance of the Service. They will immediately inform the Reseller, indicating the reasons for the blocking if security conditions allow.
The Technical Administrator will restore access to the Service as soon as the reasons justifying the blocking no longer exist.

- Consultation by the Customer
 
 
The Customer is the only one able to activate and deactivate their Customer Account, except as provided in Article 5. They are also the only one able to manage, and if necessary, modify the information on the Parameters, as well as the start-up and adjustment of the Devices.
- 
        
- Consultation by the Technical Administrator
 
 
The Customer’s access to the Service and the opening of the Customer Account necessarily implies that the Technical Administrator has access to the Customer’s Pool Data. The history of this information is stored in compliance with the Privacy Policy applied by Piscines MAGILINE.
To achieve optimal use of the iMAGI-X Box, Pool Data may be transmitted to the Reseller if the Customer consents.
If accepted, the Pool Data will be visible to the Reseller, who will then be able to review Danger Notifications. They may contact the Customer to propose a solution. This intervention will fall under the maintenance contract if the Customer has subscribed to one with the Reseller. In the absence of such a contract, the Reseller will only be required to propose a solution at the Customer’s express request. If the Customer agrees to share Pool Data, they have been informed that said data may be used by the Reseller in the context of analyzing malfunctions of the iMAGI-X Box, and that such data may reveal any non-compliant use with the User Guide provided by Piscines MAGILINE. Furthermore, if the Customer agrees to share Pool Data with the Reseller, and provided that the Reseller has subscribed to the Video Call service under the conditions of Article 3.1.2, the latter may offer the Customer, in the event of a malfunction of the Box, to carry out a remote diagnosis via a video call made through the Application. To do so, the Customer must accept the Reseller’s invitation and authorize the call to start.
Warning: if Pool Data sharing is refused, the Reseller will not have access to any Pool Data and Danger Notifications will not be transmitted to them. The Customer will then be solely responsible for managing their pool and Notifications, and for taking appropriate measures.
The Customer may change their choice to share or not share Pool Data with their Reseller at any time, from their personal space in the iMAGI-X Application.
It is recalled that, in accordance with the agreement given by the Customer when signing the order form, Pool Data sharing is enabled by default, and it is the Customer’s responsibility, during their first connection to the Service, to change this choice from their Customer Account.
- NOTIFICATIONS
 
Danger Notifications are mandatorily sent to the Customer by email to the address used to create the iMAGI-X Customer Account. They are issued when a function is blocked or stopped (the “Danger Notifications”). When configuring the Application, the Customer will be offered the option to also receive these Danger Notifications as notifications on their mobile phone.
The Customer may accept or refuse to receive on their phone the notifications issued by the iMAGI-X Application under Danger Notifications.
It is recalled that the Reseller will only have access to Danger Notifications if the Customer has authorized the sharing of Pool Data with the Reseller.

- Warning Notification FOR THE CUSTOMER
 
 
Warning Notifications are sent by email as an option to the address used to create the iMAGI-X Customer Account. Warning Notifications refer to non-blocking malfunctions (the “Warning Notifications”). When configuring the Application, the Customer will be offered the option to also receive these Warning Notifications via notifications on their mobile phone.
The Customer may accept or refuse to receive by email and/or on their phone the notifications issued by the iMAGI-X Application under Warning Notifications.
It is specified that neither Danger Notifications nor Warning Notifications create any obligation for Piscines MAGILINE, which remains solely the Technical Administrator of the iMAGI-X Application.
It is reminded that the Dealer will only have access to Warning Notifications if the Customer has authorized the sharing of Pool Data with the Dealer.
- 
        
- DEALER NOTIFICATIONS
 
 
The Dealer will mandatorily receive one email per day regarding the status of their pool portfolio. They may change their notification preferences in the My Account section of the Application.
- 
        
- Geolocation
 
 
The use of the iMAGI-X Application requires the activation of WIFI and/or Bluetooth by the Customer or the Dealer, which necessarily leads to the collection of personal data.
In addition, some Notifications require the activation of the Customer's mobile phone geolocation. As these are also personal data, the Customer’s consent will always be requested before activating geolocation, and they will remain free not to authorize the iMAGI-X Application to access the location of their mobile phone.
Any refusal may, in some cases, prevent the use of certain features.
- USE OF DATA
 
This possibility to consult the Pool Data is only intended to:
- Allow the Technical Administrator to fulfill their role as Technical Administrator,
 - Allow the Dealer to make suggestions or recommendations, provide advice and/or make commercial offers to the Customer.
 
In no way does this possibility to access the Pool Data:
- Impose on the Technical Administrator or the Dealer any duty or obligation to intervene,
 - Impose on the Technical Administrator or the Dealer any obligation to analyze the Pool Data,
 - Nor, more generally, even if the Dealer analyzes the collected information, have the purpose or effect, even implicitly or indirectly, of allowing the Customer to claim to be, or to have the right to be, informed of anomalies or malfunctions that may occur on the Equipment, or to be warned or advised on how to remedy such anomalies or malfunctions, unless they expressly request it and within the framework of a service contract to be mutually agreed with the Dealer.
 
The Customer alone remains responsible for taking the initiative to interpret the Pool Data collected, or to request its interpretation from a professional, and to verify whether this information is erroneous.
- Responsibilities
 
The Dealer accepts the Service as implemented in its current state of operation and performance. The Dealer therefore accepts the risks resulting from the limitations related to the Internet tool and its use, as well as defects in network reliability.
The iMAGI-X service is limited to granting the Dealer access to their Dealer Account.
The Customer is solely responsible for the information collected on their Customer Account, its interpretation, and its use. They are also solely responsible for the orders they place on their Equipment and for the proper execution of the commands by the Equipment.
The accuracy, consistency, and reliability of the information collected by the iMAGI-X Control Unit, as well as the proper execution of the commands to the Equipment, are moreover dependent on and subject to strict compliance with the requirements indicated in Article 3.1 General Presentation of the iMAGI-X service above. It is therefore recommended that the Customer regularly ensure on site, at the location of their pool, the perfect working condition of their equipment and devices, strictly follow the instructions provided in the iMAGI-X Control Unit User Guide, and verify that the configuration of the pool site does not interfere with the transmission and reception of information and remote commands.
It is the Customer’s responsibility to remedy any anomaly or malfunction found on the equipment and devices, to carry out all necessary repairs, to make any modification, or to replace equipment or devices as necessary by contacting their Dealer.
It is also their responsibility to enforce, where applicable, the manufacturer’s warranty on the equipment or device that proves to be defective.
It is incumbent upon the Customer, if they deem it necessary, to conclude any maintenance contract with the specialized company of their choice and to subscribe to any insurance policy of their choice.
Piscines MAGILINE cannot be held liable in the event of maintenance interrupting the Service, in circumstances beyond the control of the Technical Administrator preventing the proper functioning of the Service, in the event of accidental transmission of viruses, in the event of technical problems related to the malfunctioning of pool equipment and devices, or in the event of failure affecting telephone or electrical networks.
- Absence of warranties
 
In view of what is stated in the article above, Piscines MAGILINE provides no warranty of any kind on the Service, except for any legal warranties that may be imposed by law. No additional commercial warranty is granted by Piscines MAGILINE.
In particular, Piscines MAGILINE:
- Does not guarantee the Customer and the Dealer continuous, uninterrupted, or secure access to the Service.
 - Provides the Customer and the Dealer with no warranty whatsoever, even implied, regarding the consistency, accuracy, reliability, completeness, relevance, or efficiency of either the Pool Data collected by the Control Unit or the results obtained by it in relation to the commands sent to the Equipment, whether or not based on the information obtained in the Customer Account.
 
- CHANGE OF POOL OWNER
 
In the event of transfer of the Customer’s pool to a third party, the Customer may not transfer the benefit of their membership to the transferee. They must inform the Technical Administrator without delay so that the latter closes the Customer Account.
In this case, the Technical Administrator will also immediately suspend the Dealer’s access to the Pool Data.
The Customer may inform the transferee of the existence of the Service offered by the iMAGI-X Control Unit. If the transferee wishes to benefit from the Service, they must contact Piscines MAGILINE to request the creation of a new Customer Account. Depending on the choice of the new owner of the iMAGI-X Control Unit, the sharing of Pool Data with the Dealer will be reinstated or not.
- DEALER LEAVING THE MAGILINE NETWORK
 
So that the Customer can always be in contact with a Dealer using the iMAGI-X Application, the Customer may request from Piscines MAGILINE by email the identity of a Dealer to whom they could transfer their Pool Data. The Customer may then inform the Technical Administrator whether they wish to authorize said Dealer to access the information contained in their Account. In such a case, the Technical Administrator will transmit to the newly authorized Piscines MAGILINE Dealer the history of the information contained in the Customer Account.
- INTELLECTUAL PROPERTY
 
Piscines MAGILINE is the owner of the Application. The Application and its components are protected by copyright.
The Dealer acquires no ownership rights over the software. They have the right to use the software on a non-exclusive basis for their personal use and in accordance with the documentation provided.
The Dealer may not rent, lend, or transfer the rights to the software to any third party.
The Dealer may not modify, reproduce, adapt, distribute, publish, or translate the software. Nor may they disassemble, decompile, or attempt to recreate any of the source codes derived from the software.
- DURATION AND SUSPENSION OF THE CUSTOMER SERVICE
 
The Customer may stop using the Service at any time and request the closure of their Customer Account from the Technical Administrator.
Piscines MAGILINE may only deny the Customer access to the Service in cases of abnormal behavior by the Customer in the exercise of their granted access rights, irregularity, abuse, or serious misconduct in the use of the Service, malfunctions, damages, or repeated errors in the handling of the Service’s operating system. This termination is notified to the Customer and results in the deletion of their Customer Account and the withdrawal of their right of access to the Service.
The Technical Administrator may also, without terminating the Customer’s membership but after notifying them, suspend access to the Service for security reasons by blocking the Customer Account for the time necessary to resolve the security issues.
- DURATION AND SUSPENSION OF THE DEALER SERVICE
 
The Dealer’s access to the Service results from:
- Either their status as a member of the MAGILINE Network, status obtained following the signing of a distribution contract concluded between the Dealer and Piscines MAGILINE,
 - Or from the paid membership of a Dealer outside the MAGILINE Network who wishes to benefit from the Service. The membership conditions for a Dealer outside the MAGILINE Network, including pricing, are defined at the time of subscription by the Dealer, in a purchase order provided by Piscines MAGILINE.
 
In the event that the Dealer’s membership to the Service results from their status as a member of the MAGILINE Network pursuant to the signing of a distribution contract, the duration of membership to the Service is identical to the duration of said contract.
- PROCESSING OF PERSONAL DATA
 
If the Customer agrees to share Pool Data with the Dealer (article 6 above), the latter may collect personal data as a processor within the meaning of Regulation EU 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
The Dealer’s access to personal data will be based on the contractual consent given by the Customers via the Application, and will be for the purpose of making suggestions or recommendations, giving advice and/or making commercial offers to the Customer.
As such, the Dealer undertakes to:
- Process the data only for the purposes defined above;
 - Process the data in accordance with the instructions of Piscines MAGILINE, which acts as data controller within the framework of the Service;
 - Ensure the confidentiality of the data processed, in particular by ensuring compliance with confidentiality by its employees;
 - Not subcontract this data without the prior written authorization of Piscines MAGILINE;
 - Immediately inform Piscines MAGILINE in the event of a personal data breach occurring within its structure;
 - Take all required security measures, both physical and technical (physical security of premises, integrity clauses, backups, etc.) to ensure that the data is not altered;
 - Return or destroy the data processed under the Service to Piscines MAGILINE in the event of termination of the Service, unless expressly agreed otherwise in advance by the Customer;
 - Keep a separate processor register from that kept as data controller, mentioning the processing activities carried out on behalf of Piscines MAGILINE;
 
- Provide Piscines MAGILINE with the necessary documentation to demonstrate compliance with all GDPR obligations incumbent upon it, and to enable audits aimed at verifying compliance with these rules.
 
Piscines MAGILINE undertakes towards the Dealer to:
- Provide the relevant personal data in the event of the Customer’s consent under the conditions of Article 6 hereof, and in the event of the Dealer’s subscription to the Service;
 - Document any instruction in writing;
 - Supervise processing (audits, inspections, etc.).
 
PERSONAL DATA PROTECTION POLICY
PISCINES MAGILINE – iMAGI-X
- Purpose of processing (purpose and legal basis)
 
Piscines MAGILINE, whose registered office is at 3 rue du Labourat - ZAC des Ecrevolles 10000 Troyes France (RCS Troyes 439 450 933), is the owner of the iMAGI-X application, which can be downloaded on smartphone and tablet. Piscines MAGILINE is sometimes referred to below as “We” or “Our”. The iMAGI-X Service is a home automation system that enables the remote control and management of certain swimming pool equipment (the “Service”). The Service uses an electrical box, the iMAGI-X Control Unit, installed on the Customer’s pool, which is connected using equipment chosen by the Customer. The iMAGI-X Control Unit transmits a number of pieces of information and commands when the iMAGI-X smartphone application is used.
On this occasion, data is recorded and processed in a customer file.
The information collected in this file is necessary in order to:
- Provide the iMAGI-X Service by storing the data and making it available to customers for consultation. It also enables Piscines MAGILINE to:
        
- Send alerts to customers in the event of a malfunction,
 - Act in the event of fraudulent use of a customer account.
 
 - Carry out marketing operations (loyalty, promotions) and:
        
- send personalized advertising by email, SMS, and postal mail to customers who have consented, (i) about products similar to those they ordered, (ii) about other products offered by the company.
 - Share the data of our customers who have consented with Piscines MAGILINE’s business partners, to enable them to send advertising.
 
 - Actively manage and nurture business relationships with customers.
 
- Legal bases for processing
 
- Service management: the legal basis for processing is consent (see Article 6(1)(a) of the European Data Protection Regulation), given by the customer when creating their customer account on the iMAGI-X mobile application.
 - Sending commercial solicitations by email about products similar to those ordered by customers: the legal basis is the company’s legitimate interest (see Article 6(1)(f) of the European Data Protection Regulation), namely to promote Piscines MAGILINE products to customers.
 - Sending commercial solicitations by email about other products offered by the company: the legal basis is consent (see Article 6(1)(a) of the European Data Protection Regulation).
 - Sharing the email address with business partners: the legal basis is consent (see Article 6(1)(a) of the European Data Protection Regulation).
 
- Categories of data
 
When creating the Customer Account, the following information is collected:
- Identity: email address, title, last name, first name, phone number, address (latitude and longitude), language, time zone.
 
When using the iMAGI-X application, the following information is collected:
- Pool Data:
        
- Name and address (latitude and longitude) of the pool;
 - Water and air temperature, pH value, Redox value;
 - Pool statistics: water volume, treatment time, filtration time, product consumption;
 - Additional information: pool shape, filtration block position, location, vegetation, sun exposure, usage, pool photos (stored securely, with the option of deletion at any time);
 - Equipment configurations: control box, camera, connected speaker, accessories present, etc.;
 - List and operating status of equipment;
 - Event history: actions performed on the pool, intelligence-related events, notification history;
 - Intervention history: Chemical readings of the water (pH, Free Chlorine, Total Chlorine, Combined Chlorine, Calcium Hardness, Total Alkalinity, Cyanuric Acid, Copper, Iron, Phosphate, Salt), Product additions (Chlorine, pH, TAC, Shock Chlorine, Cyanuric Acid, Other), Refilling, Water meter readings, Cleaning (filter, vacuum, robot), Assessments (water quality rating, pool photo, comment).
 
 - Other data: IP address, custom names of accessories, video call history (no video call recordings are stored by PISCINES MAGILINE), network configuration.
 
- Data recipients
 
The iMAGI-X customer service and the sales department of Piscines MAGILINE are recipients of all categories of data.
The dealer of the iMAGI-X Control Unit, if the customer consents, will be a recipient of the customer’s identity and Pool Data.
The email addresses of customers who have consented are made available to our business partners (list of business partners, regularly updated).

The data will be retained for as long as the customer uses the Service.
At the end of the use of the Service, and if there is no other reason to continue processing, the information will be kept for five (5) years, in particular in accordance with the applicable limitation rules, or, where appropriate, for the purpose of handling any claim or request related to the services provided.
- Data necessary for loyalty actions and prospecting
 
Customers' personal data are kept for the duration of the use of the Service plus 3 years for marketing and prospecting purposes, without prejudice to retention obligations or limitation periods.
